Present law provides that "Child sexual abuse materials" is any photograph, video tape, film, or other reproduction, whether electronic or otherwise, of any sexual performance involving a child under the age of seventeen. Proposed law adds "deepfakes" to the definition of what constitutes "Child sexual abuse materials." Proposed law then seeks to exclude from the definition of "deepfakes" "any material that constitutes a work of political, public interest, or newsworthy value, including commentary, criticism, satire, or parody, or that includes content, context, or a clear disclosure visible throughout the duration of the recording that would cause a reasonable person to understand that the audioor visual media is not a record of a real event. The production, promotion, advertising, distribution, possession, or possession with the intent to distribute any sexual performance involving a child under the age of seventeen SHOULD BE ILLEGAL WITHOUT EXCLUSIONS.
