This amendment restricts access to and public disclosure of criminal history information that is currently discoverable and critical for testing the credibility of witnesses. By shielding such information from dissemination and the public record, it undermines a defendant’s ability to confront witnesses and reduces transparency in judicial proceedings. If the state maintains and relies upon these databases, it should bear a corresponding duty to disclose that information to defendants required to answer its charges.
